1. CONTEST PERIOD:

The Hydro Ottawa Limited (“Hydro Ottawa”) ‘Whiz Quiz Contest’ (the “Contest”) begins on September 16 , 2024, at 9:00 a.m. Eastern Standard Time (“EST”) and ends on November 29, 2024, at 11:59 p.m. EST (the “Contest Period”).

2. ELIGIBILITY

  • To be eligible to receive a Prize, the participant must be an elementary school student (i.e. Grades JK to 8) of a school located in Hydro Ottawa Limited’s (“Hydro Ottawa”) service territory (“Eligible Participant”)
  • Parent or guardian consent is necessary to enter the Contest.

3. HOW TO ENTER

  • To enter the Contest, an Eligible Participant must complete and submit the quiz before the end of the Contest Period.
  • Students will only have one attempt to complete the quiz each cycle. A student is eligible to enter the contest in all three cycles throughout the school year. Entry in this contest constitutes acceptance of these Contest Rules.
  • Participation of the contest is only available online and it is not available in paper format Mail in entries will not be accepted.
  • No purchase necessary.

4. PRIZE

  • The Grand Prize is an Apple® iPad 10.2” (2021) - 64GB - Wi-Fi with an approximate value of $429 CAD (“Tablet”).
  • A condition of accepting the Prize is that the Winner’s parent or guardian signs a Declaration and Release waiver.

5. WINNER SELECTION

  1. All completed quizzes submitted within the cycle will be entered into a random draw to win a tablet. One tablet will be awarded each cycle to one eligible student
  2. Odds of winning are solely dependent upon the number of eligible quiz completions received.
  3. The person listed as the adult (18+) on the quiz will be contacted and will notify the student winner of the tablet within two weeks after the completion of each cycle. The adult must respond within five (5) business days or another winner will be chosen.
  4. The parent or guardian must successfully respond to a skill testing question before it can receive the prize.
  5. Neither Hydro Ottawa nor its affiliates will be responsible for the failure for any reason whatsoever of a winner not being able to receive notification or for a winner not being able to respond as prescribed above. Before being declared a winner, the parent or guardian of the winner will be required to sign the Declaration and Release, attached hereto as Schedule B:
    1. confirming compliance with the Contest Rules and acceptance of the prize as offered;
    2. releasing Hydro Ottawa and its respective subsidiaries, affiliates, shareholders, employees, directors, officers, suppliers, agents, sponsors and administrators from any and all liability for any loss, harm, damages, cost or expense arising out of participation in this Contest or participating in any prize-related activity or the acceptance, use or misuse of any prize, including without limitation costs injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising there from;
    3. acknowledging that the Prize is provided "as is" without any warranty or condition of any kind, either express or implied; and
    4. Such agreement and release must be executed and returned to Hydro Ottawa within five (5) business days of the notification date indicated on the agreement and release or the winner will be disqualified and the prize forfeited.

6. INDEMNIFICATION BY PARTICIPANTS

By entering the Contest, each entrant:

  1. releases and holds harmless Hydro Ottawa and its respective subsidiaries, affiliates, shareholders, employees, directors, officers, suppliers, agents, sponsors and administrators from any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in this Contest, or participating in any prize-related activity; and
  2. agrees to fully indemnify Hydro Ottawa and its respective subsidiaries, affiliates, shareholders, employees, directors, officers, suppliers, agents, sponsors and administrators from any and all claims by third parties without limitation.

7.  LIMITATION OF LIABILITY

Hydro Ottawa and contest administrators assume no responsibility or liability for lost, late, delayed, misdirected or incomplete Entries, notifications, responses, replies, or any agreement and release documents or for any computer, online, telephone, hardware, software or technical malfunctions that may occur (including but not limited to malfunctions that may affect the transmission or non-transmission of an entry). Hydro Ottawa and contest administrators are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the contest or by any technical or human error which may occur in the processing of Entries in the contest. Hydro Ottawa and contest administrators assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Entries. Hydro Ottawa and contest administrators are not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing. Hydro Ottawa and contest administrators are not responsible for any injury or damage to contestants or to any computer related to or resulting from participating or downloading materials in this contest. If, for any reason, the contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Hydro Ottawa which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Hydro Ottawa and contest administrators reserve the right at their sole discretion to cancel, terminate, modify or suspend the Contest.

8. PRIVACY

Hydro Ottawa is committed to keeping personal information it collects in accordance with its privacy policy located at: https://hydroottawa.com/about/policies/privacy Hydro Ottawa will only collect and use the personal information collected pursuant to this contest for the purposes of declaring a winner. Hydro Ottawa will not transfer any personal information collected from the Contest to any third party. Hydro Ottawa will only deal with the winner’s parent or guardian at the end of the contest and it will not retain any personal information after the contest ends.

9. GENERAL

Any contestant attempting to undermine the legitimate operation of this contest shall be subject to disqualification. Such disqualification shall be without prejudice to Hydro Ottawa’s rights accruing and remedies subsisting under these Contest Rules. In addition, Hydro Ottawa shall be entitled to obtain damages from the contestant for any losses incurred directly resulting from such conduct.

This Contest is subject to all federal, provincial and municipal laws and regulations. These Contest Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over Hydro Ottawa.

Hydro Ottawa reserves the right to amend or terminate all or any portion of this contest at any time for any reason without prior notice.

  1. CONTEST PERIOD: The Hydro Ottawa Limited (“Hydro Ottawa”) ‘Emergency Preparedness Week Contest’ (the “Contest”) begins on May 6, 2024, at 12:00 p.m. Eastern Time (“ET”) and ends on May 10, 2024, at 11:59 p.m. ET (the “Contest Period”).
  2. ELIGIBILITY: To enter and be eligible to win a Prize, a person must be at the time of entry into the Contest: (i) an individual legal resident who has reached the age of majority in Ontario; and (ii) have an existing valid and active residential or commercial address within Hydro Ottawa’s service territory. Employees of Hydro Ottawa, its affiliates, advertising and promotional agencies and the immediate family and household members of those persons are not eligible to enter the Contest. Hydro Ottawa shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. Hydro Ottawa, in its sole discretion, reserves the right to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.
  3. HOW TO ENTER: NO PURCHASE NECESSARY. To enter for a chance to win a Prize, participants must: (i) “follow” Hydro Ottawa on Instagram (@hydroottawa); (ii) correctly respond to at least one of our daily questions on our Instagram Stories during the Contest Period; (iii) and comply with these Contest Official Rules. Each correctly answered question gives the participant one (1) chance to win a Prize (for a maximum of five (5) total entries). There is no cost associated with participating in the Contest. All Contest entries must be received by 11:59 p.m. ET on May 10, 2024. Hydro Ottawa is not responsible for and accepts no liability for late, lost, misdirected, delayed, or incomplete entries. Any other method of entry is void. Non-compliance with any entry procedure will result in disqualification.
  4. PRIZES: There are thirty (30) Prizes available to be won. A Prize consists of one Hydro Ottawa branded Emergency Kit, with an approximate retail value of One Hundred Dollars ($100 CAD)  (each a “Prize” and collectively the “Prizes”). The Prizes are not transferable and must be accepted as awarded with no substitutions in cash or otherwise. Hydro Ottawa reserves the right, in the event that any Prize or any component of a Prize cannot be awarded as described for any reason, to substitute another prize or component of a Prize of equal or greater value, without liability. LIMIT ONE (1) PRIZE PER HOUSEHOLD. The Prizes are subject to any terms, conditions, and restrictions imposed by their issuer or manufacturer.
  5. WINNER SELECTION: On or about 11:00 am ET on May 20 , 2024, in Ottawa, Ontario, Hydro Ottawa will randomly select up to thirty (30) entries from all eligible entries of the Contest. The chances of winning a Prize depend on the total number of eligible entries received.

    Before being declared a winner, the selected entrants will be contacted via Direct Message on Instagram to the account handle used to participate. Hydro Ottawa will contact the selected entrant who will be required to: (a) correctly answer a mathematical skill-testing question; and (b) sign and return a Declaration, Consent and Release form (the “Release Form”) in order to receive a Prize. At least two (2) attempts will be made over the five (5) days following the draw to contact the selected entrant. If a selected entrant cannot be contacted, fails to correctly answer the skill-testing question, fails to complete and return the Release Form within the five (5) business days after being contacted, or cannot accept a Prize for any reason, then at Hydro Ottawa’s sole discretion, that entrant will be disqualified and another entrant will be selected by random draw from remaining eligible entries. Hydro Ottawa will contact each winner following the receipt of their correctly answered mathematical skill-testing question and a signed Release Form to arrange for pickup of his/her Prize at our head offices located at 2711 Hunt Club Rd, Ottawa, ON K1G 5Z9. Neither Hydro Ottawa nor its affiliates will be responsible for the failure for any reason whatsoever of a winner not being able to receive notification or for a winner not being able to respond as prescribed above.
  6. INDEMNIFICATION BY ENTRANTS

    By entering the Contest, and, if applicable, completing the Release Form, each entrant: (i) releases and holds harmless Hydro Ottawa, its affiliated and related companies, shareholders, employees, directors, officers, suppliers, agents, sponsors, successors and assigns, as well as Instagram and Meta Platforms, Inc., and its respective shareholders, employees, directors, officers, agents, representatives, successors and assigns (collectively the “Released Parties”) from any and all liability for any injuries, loss or damage of any kind, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any Prize, participation in the Contest, or participating in any Prize-related activity; and (ii) agrees to fully indemnify the Released Parties from any and all claims by third parties without limitation.
  7. LIMITATION OF LIABILITY

    The Released Parties assume no responsibility or liability for: (i) any lost, late, delayed, misdirected or incomplete entries, notifications, responses, replies, or any agreement and release documents; (ii) any computer, online, telephone, hardware, software or technical malfunctions that may occur (including but not limited to malfunctions that may affect the transmission or non-transmission of an entry); (iii) any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest; (iv) or by any technical or human error which may occur in the processing of entries in the Contest; (v) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; (vi) any problems, failures or technical malfunction of any telecommunication networks or lines, computer online systems, servers, providers, computer equipment, software, email, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing; and (vii) any injury or damage to entrants or to any computer related to or resulting from participating or downloading materials in the Contest.
  8. PRIVACY AND CONSENT

    By entering the Contest, all entrants consent to the use, without compensation, of their name, including their Instagram username, audio/video images, statements and/or photograph, or other likenesses for any publicity purpose connected with the Contest within or outside of Canada.

    Each entrant hereby grants permission to Hydro Ottawa to contact them, via Instagram or otherwise, regarding any matters related to the Contest.

Hydro Ottawa will only collect, use, and disclose the personal information collected pursuant to the Contest for the purposes of administering the Contest and declaring the winners. All entries become the property of Hydro Ottawa and will be stored and destroyed in compliance with the Personal Information Protection and Electronic Documents Act and the Municipal Freedom of Information and Protection of Privacy Act.
  9. GENERAL

Such disqualification shall be without prejudice to Hydro Ottawa’s rights accruing and remedies subsisting under these Contest Official Rules. In addition, Hydro Ottawa shall be entitled to seek damages from the entrant for any losses incurred directly or indirectly resulting from such conduct.

    The Contest is subject to all federal, provincial and municipal laws and regulations. These Contest Official Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over Hydro Ottawa.

    The Contest shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Hydro Ottawa and all entrants hereby attorn to the jurisdiction of the courts of that Province, sitting in the City of Ottawa, Ontario, in respect of the determination of any matter, issue or dispute arising under or in respect of these Contest Official Rules and/or the Contest and agree that any such determination shall be brought solely and exclusively before such courts.

    Hydro Ottawa reserves the right to amend or terminate all or any portion of the Contest at any time for any reason without prior notice.

    The Contest is not in any way sponsored, endorsed, administered by, or associated with Instagram or Meta Platforms, Inc.

CONTEST PERIOD: Hydro Ottawa’sCustomer Engagement Survey contest (the “Contest”) commences at 12:00:01 p.m. Eastern Time (“ET”) on Monday, September 16, 2024 and ends at 11:59:59 p.m. ET on Sunday, October 6, 2024 (the “Contest Period”). The Contest is being sponsored by Hydro Ottawa Limited (either “Hydro Ottawa” or the “Sponsor”). Innovative Research Group Inc. (“IRG”) has been retained by the Sponsor to administer the Contest.

2. ELIGIBILITY: This Contest is open to: (i) all active Hydro Ottawa residential customers who are in good standing, are over the age of majority in Ontario as of the date of entry and reside in Ontario, and (ii) all active Hydro Ottawa small business (GS<50kW rate class) customers who are in good standing and for whom the individual entering on behalf of the small business must be: (A) a legal resident of Canada who has reached the age of majority in Ontario as of the date of entry, and (B) the owner or a decision-making representative of an existing and active small business that is legally registered and operating in Canada. Employees, agents, retirees, dealers and representatives of the Sponsor and its parent company and affiliates, IRG and its subsidiaries and affiliates are not eligible to win, nor are the spouse, parents, siblings, and children of any such employee, agent, retiree, dealer or representative or any person with whom such employee, agent, retiree, dealer or representative is domiciled.

3. HOW TO ENTER: Eligible contestants will be entered into the Contest by submitting a duly completed “Hydro Ottawa’s Customer Engagement Survey.” All submissions are to be made online only. Eligible contestants will only be allowed a maximum of one entry.

All Contest entries must be received by 11:59:59 p.m. ET on Sunday, October 6, 2024. Hydro Ottawa is not responsible for and accepts no liability for late, lost, misdirected, delayed, or incomplete entries. Any other method of entry is void. Non-compliance with any entry procedure will result in disqualification.

Entry into the Contest constitutes acceptance of these Contest Rules.

4. PRIZES: There are four (4) prizes available to be won. Each prize will consist of a five hundred Canadian dollars ($500.00 CAD) credit applied as a lump sum which will appear as “Survey contest winner credit” on each winner’s electricity bill issued within the November 2024 billing cycle (each a “Prize” and collectively, the “Prizes”) and must be used within the following twelve (12) months. The winners will be notified after Tuesday, October 15 (the “Draw Date”).

The Prize has no cash value. It must be accepted as awarded and the winners may not assign, transfer or substitute their Prize (or a portion thereof), in whole or in part.

Once the Prize has been used/spent, all new and remaining charges will be assumed by the winner. Based on each of the winner’s energy usage, it is likely the credit will be fully used prior to the end of the twelve (12) month period. In the event the Prize amount has not fully been applied to the winners’ electricity bills by the end of the twelve (12) month period, the remaining Prize amount will expire.

Hydro Ottawa reserves the right, in the event that any Prize or any component of a Prize cannot be awarded as described for any reason, to substitute another prize or component of a prize of equal or greater value, without liability.

LIMIT ONE (1) PRIZE PER HOUSEHOLD OR ORGANIZATION (AS APPLICABLE).

5. WINNER SELECTION: A random draw from all eligible entries in the Contest will take place on or around Tuesday, October 15, 2024 at 2:00 p.m. ET, and four (4) entries will be drawn. All selected contestants must meet the Contest eligibility requirements. Odds of winning are solely dependent upon the number of eligible entries. Each selected contestant will: (i) be required to correctly answer a skill-testing question; (ii) sign a release form; and (iii) must demonstrate that the Contest Rules have been complied with before the Prize can be awarded to them.

The selected contestants will be notified by phone or email, or both, and must respond within a reasonable time but by no later than ten (10) business days. If any of the selected contestant(s) does/do not respond in accordance with the Contest Rules or any selected contestant(s) does/do not correctly answer the skill-testing question or otherwise comply with the Contest Rules, he/she/they will be disqualified and will not receive a Prize.

In the event that a selected contestant is disqualified for whatever reason, another entry will be drawn from the remaining eligible entries. IRG will attempt to contact the subsequent selected contestant and the subsequent selected contestant will be subject to the same conditions as set out in this Section 5.

Neither Hydro Ottawa nor its affiliates will be responsible for the failure of a selected contestant to receive notification or for a selected contestant not being able to respond adequately as indicated above. Before being declared a winner, each selected contestant will be required to sign an agreement and release form:

  1. confirming compliance with the Contest Rules and acceptance of the Prize as offered;
  2. releasing Hydro Ottawa and its respective subsidiaries, affiliates, shareholders, employees, directors, officers, suppliers, agents, sponsors and administrators from any and all liability for any loss, harm, damages, cost or expense arising out of participation in this Contest or participating in any Prize-related activity or the acceptance, use or misuse of any Prize, including without limitation costs injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom;
  3. acknowledging that the Prize is provided "as is"; and
  4. granting Hydro Ottawa the unrestricted rights, in their collective or individual discretion, to publish without any further compensation the name, picture, portrait, likeness, voice and ideas of that selected contestant for advertising and promotional purposes.

Such agreement and release form must be executed and returned to Hydro Ottawa within ten (10) business days of the notification date indicated on the agreement and release form, otherwise the selected contestant will be disqualified and will not receive the Prize.

6. INDEMNIFICATION BY PARTICIPANTS: By submitting a survey and entering into the Contest, each eligible contestant:

  1. releases and holds harmless Hydro Ottawa, IRG and each of their respective subsidiaries, affiliates, shareholders, employees, directors, officers, suppliers, agents, sponsors and administrators (collectively the “Indemnified Parties”) from any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any Prize, participation in this Contest, or participating in the Contest or any Prize-related activity;
  2. releases and holds harmless the Indemnified Parties from any claims to intellectual property rights, including trademarks, copyright and design rights contained in any survey submission made by the eligible contestant; and
  3. agrees to fully indemnify the Indemnified Parties from any and all claims by third parties without limitation.

7. LIMITATION OF LIABILITY: The Indemnified Parties assume no responsibility or liability for: (i) any lost, late, delayed, misdirected or incomplete entries, notifications, responses, replies, or any agreement and release documents; (ii) any computer, online, telephone, hardware, software or technical malfunctions that may occur (including but not limited to malfunctions that may affect the transmission or non-transmission of an entry); (iii) any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest; (iv) or by any technical or human error which may occur in the processing of entries in the Contest; (v) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; (vi) any problems, failures or technical malfunction of any telecommunication networks or lines, computer online systems, servers, providers, computer equipment, software, email, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing; and (vii) any injury or damage to eligible contestants or to any computer related to or resulting from participating or downloading materials in the Contest.

8. PRIVACY AND CONSENT: By entering the Contest, all eligible contestants agree to: (i) the collection, use and disclosure by Hydro Ottawa and IRG of their personal information for the purposes of administering the Contest and potentially awarding a Prize, if any, including but not limited to releasing the name and photo of a winner; (ii) Hydro Ottawa’s use of their name, likeness, and statements in any marketing and promotional activities and this without compensation. This also includes publicizing the winners’ name and photo on Hydro Ottawa’s Facebook, Twitter or Instagram accounts.

All collection, use, disclosure by Hydro Ottawa of the eligible contestant’s personal information shall be in accordance with Hydro Ottawa’s applicable privacy legislation and Privacy Statement as set out on the following url:

9. GENERAL:

Such disqualification shall be without prejudice to Hydro Ottawa’s rights accruing, and to any remedies subsisting under these Contest Rules. In addition, Hydro Ottawa shall be entitled to obtain damages from the contestant for any losses incurred directly resulting from such conduct.

(2) This Contest is subject to all applicable federal, provincial and municipal laws and regulations. These Contest Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or to the policies of any other entity having jurisdiction over Hydro Ottawa.

(3) The Contest shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Hydro Ottawa and all contestants hereby attorn to the jurisdiction of the courts of that Province, sitting in the City of Ottawa, Ontario, in respect of the determination of any matter, issue or dispute arising under or in respect of these Contest Rules and/or the Contest and agree that any such determination shall be brought solely and exclusively before such courts.

(4) Hydro Ottawa reserves the right to amend or terminate any portion of this Contest at any time and for any reason, without prior notice.

(5) In case of any discrepancy between the English and French versions of the Contest Rules, the English version prevails.

Employees, agents, retirees, dealers and representatives of Hydro Ottawa, its parent company and affiliates, and IRG, its subsidiaries and affiliates are not eligible to win, nor are the spouse, parents, siblings, and children of any such employee, agent, retiree, dealer or representative or any person with whom such employee, agent, retiree, dealer or representative is domiciled.

Entry into the Contest constitutes acceptance of these Contest Rules.

4.   PRIZES: There will be four (4) random draws (each, a “Draw”) for a $500 donation to an eligible charity (“Charity”) of the winner’s choosing (the “Prize”). The winner will be notified after Tuesday, October 15, 2024 (the “Draw Date”).
The charity selected to receive a Prize must meet the following eligibility criteria:

  • Based in Ottawa and addresses issues within Hydro Ottawa's service territory;
  • Has a strategic fit with one of Hydro Ottawa's three areas of priority: education/capacity building; renewable energy, energy efficiency and conservation; health, safety and wellness;
  • Is a registered charity recognized by and in good standing with the Canada Revenue Agency;
  • Does not support political causes; and
  • Is not affiliated with religious organizations.

Notwithstanding the foregoing, Hydro Ottawa reserves the right, in its sole and absolute discretion, to decide whether the selected contestant’s choice of Charity meets the above criteria.

The Prize must be accepted as awarded and the winners may not assign, transfer or substitute their Prize (or a portion thereof), in whole or in part.

Hydro Ottawa reserves the right, in the event that any Prize or any component of a Prize cannot be awarded as described for any reason, to substitute another prize or component of a prize of equal or greater value, without liability.

5.   WINNER SELECTION: A random draw from all eligible entries in the Contest will take place on or around Tuesday, October 15 at 2:00 p.m. ET, and four (4) entries will be drawn. The selected contestants must meet the Contest eligibility requirements. Odds of winning are solely dependent upon the number of eligible entries. Each selected contestant will: (A) be required to correctly answer a skill-testing question; (B) sign a release form; and (C) must demonstrate that the Contest Rules have been complied with before the Prize can be awarded to them.

The selected contestant(s) will be notified by phone or email, or both, and must respond within a reasonable time but by no later than ten (10) business days after notification. If any of the selected contestant(s) does/do not respond in accordance with the Contest Rules or any selected contestant(s) does/do not correctly answer the skill-testing question or otherwise comply with the Contest Rules, he/she/they will be disqualified and will not receive a Prize.

In the event that a selected contestant is disqualified for whatever reason, another entry will be drawn from the remaining eligible entries. IRG will attempt to contact the subsequent selected contestant and the subsequent selected contestant will be subject to the same conditions as set out in this Section 5.

Neither Hydro Ottawa nor its affiliates will be responsible for the failure of a selected contestant to receive notification or for a selected contestant not being able to respond adequately as indicated above. Before being declared a winner, each selected contestant will be required to sign an agreement and release form:

  • confirming compliance with the Contest Rules and acceptance of the Prize as offered;
  • releasing Hydro Ottawa and its respective subsidiaries, affiliates, shareholders, employees, directors, officers, suppliers, agents, sponsors and administrators from any and all liability for any loss, harm, damages, cost or expense arising out of participation in this Contest or participating in any prize-related activity or the acceptance, use or misuse of any prize, including without limitation costs injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom;
  • acknowledging that the Prize is provided "as is"; and
  • granting Hydro Ottawa the unrestricted rights, in their collective or individual discretion, to publish without any further compensation the name, picture, portrait, likeness, voice and ideas of that selected contestant for advertising and promotional purposes.

Such agreement and release form must be executed and returned to Hydro Ottawa within ten (10) business days of the notification date indicated on the agreement and release form, otherwise the selected contestant will be disqualified and will not receive the prize.

6.   INDEMNIFICATION BY PARTICIPANTS: By submitting a survey and entering into the Contest, each Eligible Contestant:

  • releases and holds harmless Hydro Ottawa, IRG and each of their respective subsidiaries, affiliates, shareholders, employees, directors, officers, suppliers, agents, sponsors and administrators (collectively the “Indemnified Parties”) from any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in this Contest, or participating in the Contest or any prize-related activity;
  • releases and holds harmless the Indemnified Parties from any claims to intellectual property rights, including trademarks, copyright and design rights contained in any survey submission made by the Eligible Contestant; and
  • agrees to fully indemnify the Indemnified Parties from any and all claims by third parties without limitation.

7.   LIMITATION OF LIABILITY: The Indemnified Parties assume no responsibility or liability for: (i) any lost, late, delayed, misdirected or incomplete entries, notifications, responses, replies, or any agreement and release documents; (ii) any computer, online, telephone, hardware, software or technical malfunctions that may occur (including but not limited to malfunctions that may affect the transmission or non-transmission of an entry); (iii) any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest; (iv) or by any technical or human error which may occur in the processing of entries in the Contest; (v) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; (vi) any problems, failures or technical malfunction of any telecommunication networks or lines, computer online systems, servers, providers, computer equipment, software, email, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing; and (vii) any injury or damage to contestants or to any computer related to or resulting from participating or downloading materials in the Contest.

8.   PRIVACY AND CONSENT: By entering the Contest, all Eligible Contestants agree to: (i) the collection, use and disclosure by Hydro Ottawa and IRG of their personal information for the purposes of administering the Contest and potentially awarding a Prize, if any, including but not limited to releasing the name and photo of a winner; (ii) Hydro Ottawa’s use of their name, likeness, and statements in any marketing and promotional activities and this without compensation. This also includes publicizing the winners’ name and photo on Hydro Ottawa’s social media accounts.

All collection, use, disclosure by Hydro Ottawa of the Eligible Contestant’s personal information shall be in accordance with Hydro Ottawa’s applicable privacy legislation and Privacy Statement as set out on the following url:

9.   GENERAL:

(1)  Any contestant attempting to undermine the legitimate operation of this Contest shall be subject to disqualification. Such disqualification shall be without prejudice to Hydro Ottawa’s rights accruing, and to any remedies subsisting under these Contest Rules. In addition, Hydro Ottawa shall be entitled to obtain damages from the contestant for any losses incurred directly resulting from such conduct.

(2)  This Contest is subject to all applicable federal, provincial and municipal laws and regulations. These Contest Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or to the policies of any other entity having jurisdiction over Hydro Ottawa.

(3)  The Contest shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Hydro Ottawa and all contestants hereby attorn to the jurisdiction of the courts of that Province, sitting in the City of Ottawa, Ontario, in respect of the determination of any matter, issue or dispute arising under or in respect of these Contest Rules and/or the Contest and agree that any such determination shall be brought solely and exclusively before such courts.

(4)  Hydro Ottawa reserves the right to amend or terminate any portion of this Contest at any time and for any reason, without prior notice.

(5)  In case of any discrepancy between the English and French versions of the Contest Rules, the English version prevails.
